Private Client Services
We are able to assist with:
- Preparing your draft will and providing tax advice regarding your estate
- Reviewing existing wills and preparing any additions or alterations required to ensure your wills remain up to date
- Advising on the preparing Power of Attorney, to ensure that you have appointed trusted representatives to deal with your assets in the event you lose the capacity to do so
- Applications to the Court of Protection
- Advise on whether a Grant of Representation is necessary after the death of a loved one (i.e. a Grant of Probate if the individual died leaving a will or Grant of Letters of Administration if the individual died intestate)
- Advising on the distribution of an estate in the event of an individual dying intestate (i.e. without a will)
- Applying for any Grant of Representation as required and assisting with the preparation and submission of the relevant inheritance tax declarations to HMRC
- Collect in and distribute the estate on your behalf
- Providing tax advice on the estate of the deceased and preparing any Deed of Variation as required
- Dealing with legacies to minors (i.e. assets left to children and how these assets can be managed on their behalf)
Will Writing & Estate Planning
We understand that whatever the size of your estate, your assets represent your lifetimes’ achievements and the careful distribution of your most treasured possessions is important to help your loved ones through their loss. Through detailed estate planning and the preparation of a will, you can ensure that all aspects of your estate can be dealt with in the way you would wish, with a minimum amount of disruption for your surviving loved ones. This will enable you to rest assured that your family’s future is secure.
Distribution of Estate and Grant of Representation
Depending on the estate, obtaining a Grant of Representation is not always necessary to distribute an estate. We will review the details of your loved one’s estate and advise accordingly. If a Grant is necessary, we can assist to the degree you are comfortable: either by providing advice on what is required or undertaking all administration and distribution on your behalf.
Power of Attorney
Preparing a Power of Attorney allows you to decide who would manage your assets on your behalf in the event that you are no longer able to do so. Without a Power of Attorney, even your closest family may have difficulty accessing your bank accounts and assets. Preparing a Power of Attorney in advance will ensure your loved ones are able to step in as necessary to assist in making decisions on your behalf.
Court of Protection
In the event that your loved one has not made a Power of Attorney and loses the capacity to make decisions and deal with their assets, we can advise on and assist you with an application to the Court of Protection for a Deputyship Order. This will enable those most appropriate to take over management of your loved one’s finances to ensure they are cared for properly.
